Terms and Conditions
Payment: Lessee voluntarily agrees to pay an earnest deposit of 50% at the time of booking and the final payment 30 days prior to arrival.
Cancellation:
a.) To Receive a full refund, less a $75 cancellation fee, Guests must cancel at least 30 days before check-in. Guests will receive a full refund, less a $75 cancellation fee, within 48 hours of booking if the cancellation occurs at least 14 full days before the local check-in time (shown in the rental agreement).
b.) For a 40% refund, less a $75 cancellation fee, Guests must cancel between 14 and 30 days before check-in.
c.) If the Guest cancels less than 14 days in advance or decides to leave early after check-in, there is no refund.
d.) Stays for 30 nights or more. To receive a full refund, less a $75 cancellation fee, Guests must cancel within 48 hours of booking, and the cancellation must occur at least 30 days before check-in. To receive a 75% refund, less a $75 cancellation fee, the Guest must cancel at least 30 full days before arrival. If the Guest cancels within 30 days of arrival, there is no refund.
(NOTE: Airbnb and VRBO cancellations and payments will fall under Airbnb and VRBO cancellation policies. Please refer to your Airbnb or VRBO booking for specific policies if you booked through Airbnb or VRBO).
Changes: Any change to your reservation must be made at least 120 days prior to arrival. No more than one change per reservation will be allowed.
Travelers Insurance: Due to the nature of our business, most reservations are made well in advance of the arrival date. Casago strongly encourages guest(s) to purchase Travelers Insurance to help minimize any losses you may suffer from cancelations that occur after reservation becomes firm/non-refundable.
Credit Card Authorization: Guest authorizes Management Company to charge the credit card on file for deposits due and authorizes that any outstanding balances will be charged when due, as specified herein.
Collection Addendum: I/We understand and agree to pay court costs, attorney fees and a 50% collection fee on any outstanding balances over (30) thirty days past due. I/We also agree to pay 4.25% interest per month on any outstanding balances over (30) days past due.
Addenda Incorporated: Vacation Rental Agreement – The Vacation Rental Agreement has the legal location (address) of your rental property, the terms of the rental (arrival and departure dates) and the rental dollar amount plus all taxes and fees. There is no legal language in either this Reservation and Cancelation Policy or the Palm Springs Rental Agreement that allow for a continuation or renewal of the lease beyond the departure date listed
on the Rental Agreement. At the end of your rental period Tenant/Guest shall vacate the property no later than 10:00 AM and return all keys and/or garage door/gate openers to the Management Company office, unless otherwise stated at check-in. If Tenant willfully fails to vacate the premises as provided for in the agreement, the Management Company shall be entitled to recover an amount equal to twice the actual damages sustained by the landlord or one month’s rent, whichever is greater, as provided by California Law.
Crime-Free Provision: Tenant, occupants, family, guests, invitees, or other persons under the Tenant’s control shall not engage in or facilitate: (i) any acts involving imminent or actual serious property damage as defined by law; (ii) any criminal activity, including drug related criminal activity, any act of violence or threats of violence, other illegal activity, including prostitution, criminal street gang activity, threatening or intimidating, unlawful discharge of firearms, or assault; (iii) jeopardize the health, safety and welfare of tenants, Landlord, Landlord’s representatives, agents or others. VIOLATION OF THIS
PROVISION SHALL CONSTITUTE A MATERIAL AND IRREPARABLE VIOLATION OF THIS AGREEMENT AND GOOD CAUSE FOR IMMEDIATE TERMINATION OF THE TENANCY.
Marijuana: Despite legalization of marijuana in the State of California, the federal Controlled Substance Act (CSA) categorizes marijuana as a Schedule 1 substance and the possession of marijuana is a federal criminal offense. See 21 U.S.C. § 801 et seq. Casago has determined that the use or possession of marijuana, even for medical purposes, to cause a hardship on the Landlord and interferes with the health, safety, welfare and right to peaceful
enjoyment of the premises by other residents. As such, the management hereby informs and reminds all tenants that they agree to the Crime Free provision in this contract and, pursuant to that provision and the supporting federal laws, any use of marijuana (medical or otherwise) by the tenant or their guests will result in an immediate termination. If you have any questions or concerns about this policy, please speak to management. All of our homes are designated as nonsmoking.
Check-In: Check In Time – We meet and greet all guests upon arrival. Check in time is between 4:00 PM and 8:00 PM. For arrivals after 8:30 PM you will need to make special arrangements in advance. Contact information will be provided to you once your reservation has been booked.
Additional fees may apply.
Check-Out: 10:00 AM or earlier. All keys and remotes must be returned to our office unless otherwise stated at check-in.
Keys and Remotes: Guest is responsible for lost keys and remotes. We charge $25 for each house key that is not returned. Guests that fail to return community keys, Garage Remotes or Gate Remotes will be charged the cost of the replacement remote plus a $49 trip charge for picking up and programming of the remote. Community key replacement may cost as much as $100.00 plus trip charge.
Personal Mail Delivery: Guests that plan on having mail delivered will need to set up a P.O. BOX at a nearby mail store. The staff at Casago will be able to assist you in locating a mail store near the home you are renting. Casago will not issue a mail box key to any rental home/unit. UPS and FedEx parcels are deliverable to any home/unit however.
Utilities: On monthly rentals there is an electric allowance per month as follows: $100 for one bedroom, $150 for two bedrooms, $200 for three bedrooms, $250 for four bedrooms and $275 for five bedroom homes. Guest is responsible for any charges above the monthly allowance. Charges will be prorated and charged to the credit card on file. Since owners’ bills come in after usage, any extra charges to guests for utilities will in many cases occur after the guest moves out.
Housekeeping: Prior to arrival, accommodations are cleaned and provided with fresh linens. If the housekeepers have missed something, please notify us immediately so we can come out and fix it. No partial refunds will be issued for cleaning if we are unable to come out to the home, inspect, and fix the issue. Additional maid service are available on a fee-for-service basis. All of our homes are non-smoking homes. Properties in which a guest, their guests or invitees’ smoke will result in the guest being assessed an additional $500.00 cleaning charge upon his/her/their departure. Please refrain from smoking in the properties and if you must smoke please only do so outside. Property interiors must be kept clean, sanitary, safe and habitable.
Parking, Community Rules and Local Ordinances: Condos and Townhomes have limited parking availability and size restrictions on vehicles. If you are driving in a Large Truck, Van or SUV please note that most condos, townhomes and even most single family homes do not have the space required for you to park these vehicles. In addition, many HOA’s may not allow them to be parked in the driveway overnight. The Landlord cannot be held liable if your vehicle violates local parking ordinances and the Landlord cannot and will not be held responsible should your vehicle be towed or if you have to store your personal vehicle offsite and rent a car while in town. Furthermore, any fines incurred from the community HOA for parking violations will be reassessed to the Tenant. If this is the case for the particular property that you rented, then you will need to locate a storage facility for your recreational vehicles during your stay. Most of our Townhomes and single family homes that have garage parking do not have the depth required to park larger trucks and SUV’s.
Security Deposit Waiver Fee: The Deposit Waiver covers unintentional damage or loss, up to $1,500 per stay. The policy does not cover intentional acts of a guest, gross negligence or willful destruction of the owner’s property. Guest must report any loss or damage to the property or its contents to Management Company Staff, during time of stay. Damage or loss found after departure will not be covered and will be billed to the credit card on file.
Swimming Pool, Hot Tub or Spa: If the Premises contain a swimming pool, hot tub or spa. Tenant acknowledges receipt of the California private pool safety notice, which can be downloaded from the California Department of Public Health webpage:
Tenant expressly relieves and indemnifies Management Company and owners from any and all liability and responsibility for compliance with any applicable pool barrier laws and regulations.
Gas Usage: Homes with private heated pools, hot tubs, gas fireplaces, fire pits, and gas BBQ’s do not include the cost of gas in the rental rate to run them. Any usage of the gas to heat pools, spas, and gas fireplaces will be paid from an additionally required Pool Heat Deposit. Gas is billed at $1.60 per therm. By signing this agreement, guest accepts the terms of the gas usage in the rental home. Please contact Management Company immediately if there is a problem.
Propane Usage: If your rental home has appliances that run on propane, which could include pool and or spa heaters, gas grills and gas fireplaces. Our maintenance team will take a meter reading and a photograph of the meter on your scheduled check in date and check out date. After your departure we will calculate your total usage and deduct the cost from the gas deposit on file. If the deposit is not enough to cover the usage, the difference will be applied to the guest credit card on file. Guest agrees to pay for propane used during their stay. For guest that are staying long term, you will find that the propane tank will probably need to be refilled mid stay. The propane delivery companies are only in the area of the home on certain days of the week. Please keep an eye on the tank’s gas meter and call us to let us know if you would like the tank refilled or topped off during your stay. Refills during your stay will be charged to the credit card on file. The final refill at the end of your stay will be paid from the deposit on file and the difference refunded. Signature Vacation Rentals charges $3.60 per gallon of propane. *If the cost of propane goes over $3.60 per gallon, guest will be responsible for the difference.
Pools that utilize Electric Heat Pumps as the method to heat the pool: Utility allowance will apply; $100 for one bedroom, $150 for two bedrooms, $200 for three bedrooms, $250 for four bedrooms and $275 for five bedroom homes. Guest authorizes Landlord to collect payment for any electric usage over the given allowances from the Pool Heat Deposit we have on file. Additionally, Electric Heat Pumps may or may not be able to bring the pool/hot tub water up to a reasonable swimming temperature during the coldest parts of our winter season. If the home you are renting has an electric heat pump to heat the pool, spa or hot tub and having a heated pool, spa or hot tub is a material concern please call your reservation agent to discuss the matter further. No refunds or credits will be given for inability to heat the pool. By signing this agreement, guest accepts the terms of the pool heat usage in the rental home. Please contact Management Company immediately if there is a problem.
INDEMNITY AND RELEASE: THE PARTIES TO THIS AGREEMENT AGREE TO INDEMNIFY AND HOLD HARMLESS BROKERS, PROPERTY
MANAGERS, AND ANY OF THEIR RESPECTIVE AGENTS, REPRESENTATIVES OR EMPLOYEES FROM ANY LOSS, CLAIM, LIABILITY OR EXPENSE ARISING FROM INJURY TO ANY PERSON OR DAMAGE TO OR LOSS OF ANY PROPERTY, IN ANY WAY CAUSED BY THE PARTIES AND TENANT’S FAMILY, GUESTS, INVITEES, AGENTS, PETS OR OTHERS UNDER THEIR CONTROL.
Telephone: Your property may or may not have a telephone. If this is a material concern, please check with the Landlord to determine if the property you rented has phone service. Some owners provide phones for local phone calls only.
Disclaimer: The Management Company cannot guarantee your specific accommodations and we cannot be held liable should the home for some reason be uninhabitable or not available before and up to day of arrival. Incidents such as Fires, Floods, Acts of God and Trustees Sale (foreclosures) are all outside of The Landlords scope of control. If a situation arises and the home you reserved is not available or uninhabitable, The Management Company will alert you immediately to any such problems and will make every effort to find you a suitable replacement property. If we are not able to find you a replacement property that you agree to stay in, we will refund the total cost of your reservation. Any other expenses incurred like nonrefundable airline tickets, rental cars, travel expenses etc. are not the responsibility of the Management Company and or its agents. We strongly recommend travelers insurance which can be purchased directly from any legally recognized Travel Insurance Agency. Management Company has Travel Insurance Plans to offer you. Ask your Management Company Representative for details.
Access: The tenant/guest shall not unreasonably withhold consent to the landlord to enter into the dwelling unit in order to inspect the premises, make necessary or agreed repairs, decorations, alterations or improvements, supply necessary or agreed services or exhibit the dwelling unit to prospective or actual purchasers, mortgagees, tenants, workmen or contractors. Except, in case of emergency or if it is impractical to do so, the landlord shall give
the tenant at least two days’ notice of the landlord’s intent to enter and enter only at reasonable times. In the event of a maintenance issue, guest hereby authorizes Casago employees to enter the premises in guest’s absence to address maintenance concerns. This reservation may be terminated without refund, if, conduct deemed inconsiderate by Management persists, or if the maximum occupancy of the rental unit is exceeded.
Guest: Tenant/Guest agrees that their conduct and the conduct of their guests and occupants will not be disorderly, or unlawful, will not disturb the rights, comforts, and conveniences of others, and will not interfere with the quiet use and enjoyment by the other residents of the community. Guest agrees that neither they, nor their guests will engage in any illegal or prohibited activities in the home or on the property. Guest agrees not to use accommodations for the manufacture, sale or distribution of any goods, legal or illegal. Premises shall not be used to hold any events, parties or large gatherings without prior written approval from Management Company. Children under the age of 12 must have adult supervision at all times.
Tenant: Tenant or authorized signor named on this rental agreement acknowledges that they are responsible for their own actions, and the actions of their guests, and agrees to accept any and all liability for all damages done by the Tenant and/or their guest during their stay with Casago. Guest acknowledges that all of the information as noted on the confirmation is accurate and correct. Signature acknowledges that Guest understands Reservation and Cancelation Policy
Alterations and Improvements: Tenant shall not make any alterations or improvements to the Premises without Landlord’s prior written consent.
California Law: This contract shall be governed by California law and jurisdiction is exclusively conferred on the State of California.
Attorney’s Fees and Cost: The prevailing party in any dispute or claim between Tenant and Landlord arising out of or relating to this Lease Agreement shall be awarded all their reasonable attorney fees and costs, along with all cost and fees incurred as a result of any collection activity. Costs shall include, without limitation, expert witness fees, fees paid to investigators, and arbitration costs.
Internet: The Tenant(s) assume all responsibility for the access and use of any and all sites during their tenancy. They render the Property Owner and Landlord of all responsibility should there be an illegal or wrong doings or misuse of the provided Internet service. All penalties, fines and costs related to the misuse or misrepresentation while using the Internet service and site(s) are the responsibility of the Tenant.

In those states, PAC7 LLC, in California dba PAC7 Insurance Agency LLC, at 23 Corporate Plaza, Suite 150, Newport Beach, California, 92603 (herein “PAC7”), is the licensed supervising entity with training and certification of and oversight on unlicensed authorized selling and referring travel retailers
providing this travel insurance Program. In states that have not authorized a travel retailer program, travel retailers must individually possess the appropriate travel insurance sales license; if they do not, they may only refer interested parties to appropriately licensed parties. This plan provides insurance coverage that only applies during the covered trip. You may have coverage from other sources that provides you with similar benefits but may be subject to different restrictions depending upon your other coverages. You may wish to compare the terms of this policy with your existing life, health, home, and automobile insurance policies. If you have any questions about your current coverage, call your insurer or insurance agent or broker. (i)
Purchasing travel insurance is not required in order to purchase any other product or service offered by the travel retailer. (ii) As an authorized travel retailer of PAC7, no employee of the travel retailer is qualified or authorized to: (a) provide technical explanations, representations or interpretations, or answer technical questions about, coverage provisions, benefits, exclusions, terminology and conditions of any of the insurance offered by travel retailer; (b) evaluate the adequacy of the prospective insured’s or travel/rental guest’s current existing insurance coverage; (c) otherwise advertise, hold out or present themselves in such a way as to be perceived as a fully licensed agent.
